Terms and Conditions

Accomplish Asia Sdn Bhd (“Accomplish”) controls your personal data and operates accomplish.asia (“Site”) and is making it available to you subject to these evolving Terms and Conditions (“Terms”). The Terms govern your access to and use of Accomplish products available via the Site. The Site includes Accomplish’s related websites, SMS, APIs, email notifications, applications, buttons, widgets, ads, commerce services, and any other related services that can be accessed via our Site or that link to these Terms, and any information, text, links, graphics, photos, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Site (collectively referred to as “Content”).

In the event of inconsistency between any terms of this agreement and any translation into another language, the English version will prevail on any question of interpretation or otherwise. Accomplish is committed to protecting your personal information. These Terms include and incorporate by reference our Privacy Policy explains the types of information collected, stored, shared and processed, how and why we use such information, who we share it with and your legal rights.

Your agreement with us

Please read through these Terms carefully. By accessing or using any of Accomplish’s public, private and/or restricted-use Sites including but not limited to: accomplish.asia, or by otherwise accessing any Content found on the Site or services available through the Site (“Site Services“), you are deemed to (i) have entered into an agreement with Accomplish or any of its affiliates (collectively, “Accomplish“); (ii) have represented that you are an adult in your country of residence and are at least 18 years old; (iii) have represented that you have the legal authority to accept these Terms; and (iv) have agreed to be bound by the terms set out below. If you do not agree with the Terms, you are not authorized to, and may not, use or access the Site.

Changes to this policy

These Terms apply to you from the date of publishing and until these Terms are superseded by a new version. Accomplish may update these Terms at any time for legal or regulatory reasons, or to reflect changes in our services or business practices. Any amended Terms will be posted here.

Intellectual property rights

All intellectual property rights in and to Accomplish Products (the “Products”), and all materials distributed at or in connection with the Products are owned by Accomplish, Accomplish’s related companies, and/or Accomplish sponsors or speakers. You must not reproduce or allow anyone one to reproduce any materials distributed by or on behalf of Accomplish for any reason, without prior written permission from Accomplish.

Nothing in these Terms shall vest in you any legal or beneficial right in or to any intellectual property rights owned or used under licence by us, our related companies or our affiliates, or grant to you any right or licence to any other intellectual property rights of us, our related companies or our affiliates. All such intellectual property rights shall remain the exclusive property of us, our related companies or our affiliates.

It is strictly forbidden for any company, organisation, or person to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to a conference or its affiliates without the prior written permission and cooperation of us. We reserve their right to take such action (legal or otherwise), including a claim for damages as we, in our sole discretion, deem appropriate in the circumstances.

Limitation of Liability

Accomplish will not be liable for direct or indirect damages of any kind, including without limitation, incidental, punitive or consequential damage or loss arising out of or in connection with the Terms, the Site, the Products, inability to use the Site or the Site Services, or resulting from any goods or services obtained or messages received or transactions entered into through the Site or the Products.

You acknowledge that there are security, privacy and confidentiality risks inherent in online communications and associated technology. You agree that Accomplish will not be responsible or liable, under any circumstances, for any:

access delays or access interruptions to the Site;
data non-delivery, mis-delivery, corruption, destruction or other modification;
loss or damages of any kind incurred as a result of dealings with or the presence of off-site links on the sites;
computer viruses, system failure or malfunction that may occur in connection with your use of the Sites, including during hyperlink to or from third-party website;
decisions made or actions taken by the user or a third party in reliance on the Site or Content; or
events beyond our reasonable control.

You acknowledge and agree that views expressed by speakers at or in connection with an event are their own and we do not accept any responsibility or liability for any advice given or views expressed during or in connection with an event.

Materials shared or distributed at or in connection with an event are intended for information purposes only and should not be relied upon by you or others. We and our related companies do not provide any guarantees, conditions or warranties that the materials are complete or accurate and do not accept any responsibility or liability for reliance by you or any person on any aspect of the event and/or any information provided at the event.

Nothing in these Terms purports to exclude or limit liability for any fraudulent statement or act or in respect of any liability that cannot be excluded or limited under applicable law.

Disclaimer of Warranties

The Accomplish Site and the Products are provided on an “as is” and “as available” basis. Accomplish makes no representations or warranties of any kind, express or implied, concerning the Site, the Products or the Content thereof.

Your use of the Site is at your own risk, and you, and not Accomplish, assume the entire cost of any necessary servicing, repair or correction in the event of any loss or damage arising from the use of the Site or their Content. Accomplish expressly disclaims all warranties, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, title, or non-infringement.

Accomplish does not guarantee the accuracy, reliability or timelines of the Content or Site Services, that the functions or Content contained in the Site will be uninterrupted or error-free, that defects will be corrected or that the Site or related systems are free from viruses or other contaminating or destructive properties. Accomplish makes no warranties that your use of the Content will not infringe the rights of others and assumes no liability or responsibility for errors or omissions in such Content. No verbal or written representations, information or advice given by Accomplish or its authorized representatives shall create or expand any warranty.

Indemnity

You agree to defend, indemnify and hold Accomplish, its affiliates, joint ventures, licensees, licensors, content providers, third-party service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties“) harmless from all claims, liability, damages, losses, costs and expenses, including legal fees, resulting from any breach of the Terms by you, including (a) any use of Content other than as expressly authorized in the Terms of Use, or (b) any use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our systems. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of Sites, Site Services or Content.

Force majeure

We are not liable if the delivery of an Accomplish Product is, in whole or in part, cancelled, rescheduled or postponed, or for any failure or delay to perform our obligations under these Terms, if such event results from anything beyond our reasonable control (for example, natural disasters, flood, fire, acts of terror, war, labour strike, extreme weather malicious damage, compliance with any law or governmental order, or mechanical, electronic or communications failure or degradation, or any other emergency) or anything else that renders the delivery of the Accomplish Product, in whole or in part, impracticable, illegal or impossible.

Product Purchase and Event Attendee Terms

Products and pricing

All Accomplish products prices are correct at the time of publication. When you order an Accomplish product, you have an opportunity to review and accept the fees that will be charged. Prices, availability, and other purchase terms are subject to change. Accomplish reserves the right to change the product specifications and prices without prior notice. However, changes made will not affect the products that have already been purchased. Kindly note that fees may be subject to taxes.

You are responsible for providing true, accurate, current, and complete information when ordering products through the Accomplish website or otherwise. If you use the Accomplish website or other means to purchase a product, payment must be received prior to acceptance of an order. Accomplish may need to verify information you provide before your order is accepted, and may cancel or limit your order any time after it has been placed. Subject to applicable membership policies, if payment has already been made and your order is cancelled or limited, Accomplish will refund any payment you made for the product that will not be delivered due to cancellation or limitation of an order in the same tender as the original purchase.

For Accomplish events, valid event ticket entitles you to entry to the relevant event as an Attendee, but does not include any requirements associated with travel to or from the event or any accommodation costs incurred and we shall have no liability for such costs or expenses.

Reselling or otherwise transferring your ticket, not in accordance with the Terms, will void the ticket and the ticket holder will not gain entry into the event. Where there has been any resale or attempted resale of any tickets (or any other breach of this term), we reserve the right to cancel the relevant tickets with immediate effect.

Discounts

From time to time, Accomplish may offer certain discounted promotions for selected products. We reserve the right to change or withdraw a discount offer at any time at our sole discretion.

Visa requirements

It is your sole responsibility to take care of visa requirements. If you require an entry visa to attend or volunteer at an event, you must allow sufficient time for the visa application procedure.

In the event you are not granted a visa, we are under no obligation to refund your ticket unless you make a cancellation request for a refund in writing to admin@accomplish.asia no later than 14 days before the event.

Registering on behalf of another

If you are registering on behalf of another person, it is your obligation to make sure that the person attending is aware of these Terms and accepts them. By completing and submitting the registration form, you are representing and warranting that you have made the person attending aware of these Terms and that they have accepted these Terms.

Cancellation and refunds

Any request for a refund for Accomplish products must made in writing to Accomplish, no later than 14 days before the product’s commencement date. Purchases of Accomplish products are non-refundable if the request for a refund is made less than 14 days before the product’s commencement date.

For Accomplish Events, if an Attendee finds that they cannot attend an event and would like to request a name change on their ticket, they must notify Accomplish as soon as possible (and in any event no later than 7 days before the commencement of the event) by email at: admin@accomplish.asia. We may in our absolute discretion allow or disallow the name change. Alternatively, attendees who wish to make a cancellation can request for a refund no later than 14 days before the event. In the event of a cancellation request, kindly note that there will be a 15% processing fee deduction from the original ticket purchase price.

For all requests for refunds, kindly note that there will be a 15% processing fee deduction from the original purchase price. This processing fee is non-refundable in its entirety.

Volunteer Terms

Volunteer selection

You may apply to be a volunteer (“Volunteer”) at an Accomplish event.

However, there is no guarantee that applicants wishing to volunteer at the event will be selected and the selection of Volunteers is at our sole discretion.

Selected Volunteers must attest to the truth of all statements made in their volunteer application.

Without limiting their other obligations under these Terms, Volunteers are subject to the following rules governing their relationship with us:

Volunteers will not receive compensation for travel or accommodation associated with the event;
Volunteers who violate any of these Terms, behave in a manner that could be disruptive to the event or any other participant, volunteer, sponsor and/ or partner, consume alcohol and/or illegal substances before or while on duty, or fail to show up for an assigned shift may be stripped of their credentials, denied access to the event, and may be subject to removal from the event grounds;
Volunteers acknowledge that they may be photographed or recorded in accordance with the section “Photography, Audio and Video Recording”; and
Volunteers who may be handling confidential information agree to handle such information in the strictest confidence and abide by the rules governing its use as provided for in the Privacy Policy.
